The foundational stage where every defect, gap, and complication is systematically identified and documented.
Every title problem has a root cause. Before any resolution path can be determined, the complete landscape of defects must be mapped. This stage establishes the factual foundation upon which all subsequent decisions are made.
Review of commitment letters, title commitments, exception reports, and all documentation provided by the title company to identify each flagged exception.
Systematic listing of every title defect found: liens, encumbrances, ownership gaps, chain of title breaks, probate issues, or other clouds on title.
Initial categorization of each defect by type, severity, and likely resolution complexity to establish baseline understanding of the case.
Identification of missing documents, records, or information needed to fully understand and address each identified title issue.
During Stage 1, these categories of title problems are systematically evaluated:
Mortgages, HELOCs, tax liens, mechanic's liens, judgment liens, HOA liens
Missing heirs, deceased owners, intestate succession, unlocated parties
Breaks in ownership history, deed gaps, unrecorded conveyances
Open estates, contested probates, missing executors, estate administration
Delinquent property taxes, tax deed issues, special assessments
Metes and bounds discrepancies, parcel ID mismatches, boundary disputes
